Terms of Service (Generic)

1. Introduction

Welcome to Little Legs Studio LTD. By accessing or using our services, you agree to comply with and be bound by the following terms and conditions.

2. Definitions

  • "Services" refers to all production services provided by Little Legs Studio LTD.

  • "Client" refers to any individual or entity that engages Little Legs Studio LTD for services.

  • "Content" refers to any media, including but not limited to video, audio, and images, produced by Little Legs Studio LTD.

3. Acceptance of Terms

By using our Services, the Client agrees to be bound by these Terms of Service and any additional terms and conditions that may apply.

4. Services Provided

Little Legs Studio LTD offers a range of production services. Detailed descriptions of our services can be found on our website.

5. Liability

Liability for creative, ads, and performance sits with the Client. Little Legs Studio LTD and the team will work to the best of their abilities with the Client's interest in mind but cannot be held accountable for any loss of revenue or sales as this is beyond reasonable control.

6. Billing and Payment

  • Billing should be paid on time unless prior agreements are made.

  • We work on a billing cycle of the 20th of the month for clients on account or retainer. If you are not on account or have a retainer you will be expected to pay before final files are delivered. Any bills paid late will cause services to be stopped until the payment is settled.

  • If a deposit is required once paid, the Client has accepted the above billing schedule and these Terms of Service and agrees to complete the full amount of work listed within 90 days.

  • Refunds are not offered nor should be expected.

  • You have the option of invoice or credit card payments. If two invoices are late you will be required to pay by credit card or move to a prepaid account.

7. Intellectual Property and Storage

  • All RAW files, project files, and IP belong to the Client with full copyrights.

  • RAW files and project files are stored for up to 30 days after the project is completed, marked by the final invoice payment. It is the Client's responsibility to organise the transfer of data to a storage location of their choosing.

  • We reserve the right to reshare material for Little Legs Studio LTD and third-party suppliers marketing purposes if they are involved in working with you; however, it will not be shared with other clients or suppliers without your written permission.

8. Project Basis and Scope Changes

  • Little Legs Studio LTD works on a project-by-project basis. This means no time logging is available. We will work until the project is completed based on the original brief.

  • If additional elements are added to a project without notice, Little Legs Studio LTD may choose to pause the project until a new brief and budget is agreed upon.

  • Budget is based on the initial scope of work. If the scope changes, additional budget beyond our fixed price agreement may be required.

9. Cancellation

  • If a client requires a project to be cancelled before completion, they will be required to pay 50% of the remaining invoices.

  • If a client requires a retainer to be cancelled they are required to give us 30 day's notice before the retainer auto renews.

10. Travel Expenses

  • Travel is included in all pricing throughout the Auckland and Hamilton regions. Additional travel may require additional fees.

11. Confidentiality

All information shared with Little Legs Studio LTD is confidential and considered commercially sensitive. Both parties agree to keep all disclosed information confidential and not to disclose such information to any third party without prior written consent.

12. Limitation of Liability

Little Legs Studio LTD will not be liable for any indirect, incidental, or consequential damages arising out of or in connection with the services provided.

13. Governing Law

These terms are governed by the laws of New Zealand. Any disputes will be resolved in the courts of New Zealand.

14. Amendments

Little Legs Studio LTD reserves the right to amend these Terms of Service at any time. Clients will be notified of any changes in writing. Retainer clients may be offered the ability to exercise their cancellation clause earlier than dated if terms change.
